4. Booking Services

When you book a service with Touch Spa, you agree to the following terms:

4.1 Booking Process

Bookings can be made via our website, by phone, or through WhatsApp. All bookings are subject to availability. We will confirm your booking via the contact information you provide. It is your responsibility to ensure that the contact information you provide is accurate and up to date.

4.2 Cancellation and Rescheduling Policy

We require a minimum of 2 hours notice for cancellations or rescheduling. Cancellations made with less than 2 hours notice may incur a fee equivalent to 50% of the service cost. Failure to attend a booked appointment without prior notice may result in a charge of 50% of the service cost.

We understand that emergencies happen. If you need to cancel or reschedule, please contact us as soon as possible. We will do our best to accommodate you.

4.3 Late Arrivals

If you arrive late, we will do our best to provide you with a full treatment. However, please note that your session may be shortened to avoid delaying subsequent bookings. The full fee will still apply for shortened sessions.

4.4 Payment

Payment is due at the time of service. We accept cash, all major credit and debit cards, and mobile banking (bKash, Nagad, Rocket). All prices are in Bangladeshi Taka (BDT) and include applicable taxes.

5. Health and Safety

Your health and safety are our top priorities. By booking a service with us, you confirm that you have disclosed any relevant health conditions, injuries, or allergies that may affect your treatment. This includes but is not limited to:

  • Pregnancy or recent childbirth
  • Recent surgery or injuries
  • Chronic medical conditions (e.g., heart disease, high blood pressure, diabetes)
  • Allergies to oils or other products used
  • Skin conditions that may be affected by massage
  • Any other conditions that may impact your ability to receive massage therapy

If you are unsure whether massage therapy is suitable for you, we recommend consulting with your healthcare provider before booking.

We reserve the right to refuse or modify a treatment if we believe it may be unsafe for you. Your therapist will discuss any concerns with you before the session begins.

6. Intellectual Property

The website and its original content, features, and functionality are and will remain the exclusive property of Touch Spa & Wellness and its licensors. The website is protected by copyright, trademark, and other laws of Bangladesh and foreign countries.

You may not copy, distribute, modify, create derivative works of, publicly display, or republish any content from our website without our prior written consent. You may, however, share links to our website on social media or other platforms, provided you do not misrepresent the content.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Touch Spa.

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Dispute Resolution

Arbitration. If we are unable to resolve the dispute informally, the dispute shall be resolved through binding arbitration in accordance with the Bangladesh Arbitration Act. The arbitration shall be conducted in Dhaka, Bangladesh, and shall be conducted in English.

Small claims. For disputes involving amounts below BDT 50,000, you may bring the claim in a small claims court in Dhaka, Bangladesh, instead of arbitration.

Exceptions. This dispute resolution process does not apply to claims of intellectual property infringement or claims that may be brought in a court of competent jurisdiction.
